für Deutschkurse A1.1 bis B1.2 und den Orientierungskurs

1. Anmeldung und Zahlung

1. Die Anmeldung erfolgt in der Regel persönlich während der wöchentlichen Deutschkurs-Beratung.
   Sie muss mindestens eine Woche vor Kursbeginn erfolgen.

2. Zur Reservierung eines Kursplatzes ist vor Kursbeginn eine Anzahlung zu leisten.

   • Diese beträgt die Hälfte der Gebühren für ein Modul.
   • Die restlichen Kursgebühren sind zu Beginn des Kurses fällig.
   • Bei Folgemodulen ist die Zahlung jeweils zu Beginn des neuen Moduls zu leisten.
3. Die Zahlung erfolgt bar während der Deutschkurs-Beratung.

4. Wer eine andere Person anmeldet, haftet vollständig für die Einhaltung aller Vertragspflichten.

5. Die Sprachkurse sind von der Mehrwertsteuer befreit.

2. Kurse, Zeiten und Unterrichtsmaterial

1. Die Einstufung erfolgt anhand der Angaben bei der Beratung und eines Einstufungstests.

2. Ein Deutschkurs besteht in der Regel aus sechs Modulen mit jeweils 100 Unterrichtsstunden.

3. Der Unterricht findet üblicherweise an vier Tagen pro Woche statt.
   Pro Tag werden vier Unterrichtsstunden erteilt.
   Eine Unterrichtsstunde dauert 45 Minuten.

4. Die Teilnehmenden verpflichten sich zu regelmäßiger und pünktlicher Teilnahme.\
   Bei Abwesenheit erfolgt keine Rückerstattung der Kursgebühren.
   Versäumter Unterricht wird nicht nachgeholt.

5. Der Übergang in das nächste Modul erfolgt automatisch, sofern keine Kündigung erfolgt.

6. Babylonia e.V. kann Kurse absagen, zusammenlegen oder auflösen, wenn die Mindestteilnehmerzahl nicht erreicht wird.

7. Kurs- und Arbeitsbücher werden nicht gestellt.
   Die Teilnehmenden müssen diese rechtzeitig selbst beschaffen.

3. Teilnahmebestätigung und Prüfungen

1. Auf Wunsch stellt Babylonia e.V. eine Teilnahmebestätigung aus.

2. Für berechtigte Teilnehmende an Integrationskursen wird nach Abschluss der sechs Module die vom Bundesamt genehmigte B1-Prüfung durchgeführt oder vermittelt.

4. Kündigung

1. Eine Kündigung ist bis zum Kursbeginn schriftlich oder mündlich möglich.
   Bereits gezahlte Kursgebühren werden vollständig zurückerstattet.

2. Nach Kursbeginn ist eine Rückerstattung ausgeschlossen.

3. Das Recht zur außerordentlichen Kündigung aus wichtigem Grund bleibt unberührt
   (zum Beispiel bei schwerwiegenden Umständen gemäß § 626 BGB).

5. Pflichten von Babylonia e.V.

Babylonia e.V. verpflichtet sich:

1. die Kurse sorgfältig vorzubereiten
2. qualifizierte Lehrkräfte auszuwählen
3. den Unterricht ordnungsgemäß durchzuführen

Fällt eine Lehrkraft aus, kann eine Vertretung eingesetzt werden.
Kann Unterricht kurzfristig nicht stattfinden, wird er nachgeholt.
Für die Teilnehmenden entstehen dadurch keine zusätzlichen Kosten.

6. Haftung

1. Schadensersatzansprüche sind ausgeschlossen, außer:
   • bei Verletzung von Leben, Körper oder Gesundheit
   • bei Verletzung wesentlicher Vertragspflichten
   • bei Vorsatz oder grober Fahrlässigkeit

   Wesentliche Vertragspflichten sind Pflichten, ohne deren Erfüllung der Vertrag seinen Zweck nicht erreichen kann.

2. Bei einfacher Fahrlässigkeit haftet Babylonia e.V. nur für den typischen und vorhersehbaren Schaden.

3. Diese Regelungen gelten auch für gesetzliche Vertreter und Erfüllungsgehilfen.

7. Änderungen der AGB

Änderungen oder Ergänzungen bedürfen der Schriftform.
Mündliche Nebenabreden bestehen nicht.

Die AGB werden allen Vertragspartnern zur Kenntnis gegeben.
Ihre Anerkennung ist Bestandteil des Vertrags.

8. Unterrichtsort

Der Unterricht findet in der Regel in den Räumen von Babylonia e.V. statt:
Cuvrystraße 23, 10997 Berlin.

9. Salvatorische Klausel

Sollten einzelne Regelungen unwirksam sein, bleibt der Vertrag im Übrigen wirksam.
An die Stelle der unwirksamen Regelung tritt die gesetzliche Regelung.

1. Registration and Payment

1. Registration normally takes place in person during the weekly German course consultation.
   Registration must be completed at least one week before the start of the course.

2. To reserve a place on a course, a deposit must be paid before the course begins.

   • The deposit amounts to half of the fee for one module.
   • The remaining course fees are due at the start of the course.
   • For subsequent modules, payment is due at the beginning of each new module.
3. Payment must be made in cash during the German course consultation.

4. Any person registering another individual is fully liable for compliance with all contractual obligations.

5. The language courses are exempt from value added tax (VAT).

2. Courses, Schedule and Course Materials

1. Placement in a course level is determined on the basis of the information provided during the consultation and a placement test.

2. A German language course generally consists of six modules, each comprising 100 teaching units.

3. Classes are usually held on four days per week.
   Four teaching units are held per day.
   One teaching unit lasts 45 minutes.

4. Participants are required to attend classes regularly and punctually.
   No refund of course fees is granted in the event of absence.
   Missed classes are not made up.

5. Progression to the next module takes place automatically unless the participant gives notice of termination.

6. Babylonia e.V. reserves the right to cancel, merge or discontinue courses if the minimum number of participants is not reached.

7. Course books and workbooks are not provided.
   Participants are responsible for obtaining the required materials in good time.

3. Certificates of Attendance and Examinations

1. Upon request, Babylonia e.V. will issue a certificate of attendance.

2. For eligible participants in integration courses, the B1 examination approved by the Federal Office for Migration and Refugees is conducted or arranged after completion of the six modules.

4. Termination

1. The contract may be terminated in writing or orally up to the start of the course.
   Any course fees already paid will be refunded in full.

2. After the course has begun, no refund is possible.

3. The right to extraordinary termination for good cause remains unaffected
   (for example in the case of serious circumstances in accordance with section 626 of the German Civil Code).

5. Obligations of Babylonia e.V.

Babylonia e.V. undertakes to:

1. prepare the courses with due care
2. select qualified teaching staff
3. conduct the courses properly as scheduled

If a teacher is unavailable, a substitute teacher may be appointed.
If classes cannot take place at short notice, they will be rescheduled.
No additional costs will arise for participants as a result.

6. Liability

1. Claims for damages are excluded, except in cases of:
   • injury to life, body or health
   • breach of essential contractual obligations
   • intent or gross negligence

   Essential contractual obligations are obligations whose fulfilment is necessary to achieve the purpose of the contract.

2. In cases of slight negligence, Babylonia e.V. shall only be liable for foreseeable damage typical of the contract.

3. These limitations of liability also apply in favour of the legal representatives and vicarious agents of Babylonia e.V.

7. Amendments to the Terms and Conditions

Any amendments or supplements to these Terms and Conditions must be made in writing.
No verbal side agreements exist.

The Terms and Conditions are made available to all contracting parties.
Their acceptance forms an integral part of the contractual relationship.

8. Place of Instruction

Classes are generally held on the premises of Babylonia e.V.:
Cuvrystraße 23, 10997 Berlin, Germany.

9. Severability Clause

Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
The statutory provision that most closely reflects the economic purpose of the invalid provision shall apply in its place.
